    A federal judge in Florida has ruled that a state law restricting access to transgender medical care is unconstitutional. The decision, issued on Tuesday, deals a significant blow to Governor Ron DeSantis’ policies targeting transgender individuals.

    The law, Senate Bill 254, enacted in May 2023, prohibited medical professionals from prescribing puberty blockers and hormone therapy to transgender minors. It also placed limitations on access to this care for adults. Plaintiffs, including transgender adults and parents of transgender minors, challenged the law’s constitutionality.

    U.S. District Judge Robert Hinkle permanently blocked enforcement of the law. In his ruling, Judge Hinkle emphasized the established medical consensus surrounding gender-affirming care, stating that “gender identity is real” and that such treatments are part of the “widely accepted standard of care” for transgender individuals experiencing gender dysphoria.

    The judge further criticized the law’s basis, rejecting the notion that transgender identity is a choice. He compared it to a matter of personal preference, like choosing between reading Shakespeare or John Grisham. Additionally, Judge Hinkle found evidence of bias in the legislative record, citing inflammatory rhetoric used by some lawmakers during the bill’s passage.

    The ruling applied “intermediate scrutiny” to the law, requiring it to demonstrate a substantial connection to an important state interest. Judge Hinkle concluded that the law failed to meet this standard, targeting transgender people without a legitimate justification.

    This decision is a major victory for transgender rights advocates in Florida. However, the state is likely to appeal the ruling, setting the stage for a potential legal battle.
